Patent prosecution is a deadline-driven process with statutory time limits that cannot be extended without penalty — and some that cannot be extended at all. Missing the 12-month provisional deadline extinguishes priority rights. Failing to respond to a USPTO office action within the statutory window abandons the application. A Gantt chart for patent filing does not replace patent counsel, but it ensures that every person involved — inventors, IP managers, executives, and attorneys — has a shared view of every critical date.

Why Patent Timelines Require Visual Management

Patent applications move through multiple phases over years, not weeks. A non-provisional application filed today may receive a first office action 18–24 months later. Continuation decisions must be made before the parent application issues. Maintenance fees are due at 3.5, 7.5, and 11.5 years after grant. Without a timeline that spans years and tracks every milestone, critical deadlines get missed in the noise of day-to-day operations.

Phase 1: Invention Disclosure (Weeks 1–3)

The patent process begins when an inventor submits an invention disclosure form (IDF) to the IP department or outside counsel. The IDF documents what was invented, when it was conceived, how it works, who the inventors are, and what prior art the inventors are aware of.

Key actions in this phase:

  • Inventor completes IDF with engineering support
  • IP manager reviews for completeness and assigns a docket number
  • Initial patentability review scheduled

Milestone: IDF submitted and accepted into IP docket.

Phase 2: Prior Art Search (Weeks 3–7)

A prior art search identifies existing patents, patent applications, and non-patent literature that may affect patentability. This can be conducted by in-house IP staff, outside counsel, or a professional search firm.

The search covers: USPTO database, EPO Espacenet, Google Patents, and relevant technical literature. Plan for 2–4 weeks for a thorough search, depending on the technology area.

The prior art search results directly inform whether to proceed with a provisional application, file a full non-provisional directly, or abandon the idea before incurring filing costs.

Milestone: Prior art search report delivered and reviewed by IP team and inventors.

Phase 3: Patentability Opinion (Weeks 6–10)

Based on the prior art search results, patent counsel issues a written patentability opinion assessing the likelihood that the invention is novel and non-obvious over the prior art. This opinion is attorney-client privileged and informs the strategic decision to file.

The patentability opinion also identifies the strongest claim scope — broad claims that distinguish over prior art — which shapes the drafting strategy for the application.

Milestone: Patentability opinion received. Go/no-go decision made by IP committee or management.

Phase 4: Provisional Application Filing (Weeks 8–12)

If the decision is to proceed, a provisional patent application is typically filed first. A provisional:

  • Establishes a priority date (the date from which novelty is assessed)
  • Starts the 12-month clock to file a corresponding non-provisional application
  • Does not get examined by the USPTO
  • Is never published and never issues as a patent on its own

The provisional should describe the invention in full — drawings, specifications, working examples. Do not file a thin provisional and expect to expand claims in the non-provisional. The priority date only protects subject matter actually disclosed in the provisional.

Cost: USPTO micro-entity filing fee is $320 (2026 rates); small entity is $640; large entity is $1,280.

Critical milestone: Provisional application filed. 12-month non-provisional deadline set. This date goes directly into the Gantt as an immovable deadline.

Phase 5: Patent Claims Drafting (Months 3–9 after provisional filing)

Independent and dependent patent claims are the legal heart of the patent. They define the exact scope of protection. Drafting typically begins 3–6 months after the provisional filing to allow time for the invention to mature and for additional embodiments to be developed.

Claims drafting is an iterative process: patent counsel drafts, inventors review for technical accuracy, counsel revises, IP manager reviews for strategic alignment with the business. Plan for 3–4 drafting rounds.

Claims structure: begin with the broadest independent claim that can be supported by the specification and distinguished from prior art. Layer dependent claims to add specificity and fallback protection.

Milestone: Claims draft approved by inventors and IP management.

Phase 6: Drawings Preparation (Months 4–10 after provisional filing)

Patent drawings must meet strict USPTO formatting requirements: specific line weight, labeling conventions, no shading in many cases, specific figure numbering. Use a patent illustrator (or dedicated software) rather than engineering drawings, which rarely meet USPTO standards.

Drawings are reviewed as part of the non-provisional application drafting process. Budget 2–4 weeks for drawings, plus 1–2 weeks for review and revision.

Milestone: Drawings approved and formatted to USPTO standards.

Phase 7: Non-Provisional Application Filing (Month 11 — before the 12-month provisional deadline)

The non-provisional patent application must be filed within 12 months of the provisional filing date. This is a hard statutory deadline. Filing one day late means losing the provisional priority date — which may mean losing the patent entirely if intervening prior art has published.

Build a buffer into the Gantt: target filing at Month 10, not Month 12. This buffer absorbs delays in attorney review, inventor sign-off, and USPTO system outages on high-traffic filing days.

The non-provisional application includes: specification, claims, abstract, drawings, oath/declaration, and application data sheet. File electronically through the USPTO's EFS-Web (now Patent Center).

Critical milestone: Non-provisional application filed. USPTO application number and filing receipt received.

Phase 8: USPTO Office Action Response Window (18–24 Months After Filing)

The USPTO will issue a first office action (FOA) examining patentability of the claims. The FOA typically includes rejections under 35 U.S.C. § 102 (novelty) or § 103 (obviousness). Receiving a rejection is normal — do not interpret it as the end of the application.

Statutory response deadline: 3 months from the mail date of the office action. Extensions are available in 1-month increments up to 6 months total, at escalating cost. After 6 months, the application is abandoned.

Response options: amend claims, submit arguments distinguishing prior art, or both. Mark the 3-month statutory deadline on your Gantt immediately upon receiving the office action, plus the 6-month hard deadline.

After the response, the USPTO issues either a notice of allowance or a final office action. After a final rejection, options include: requesting continued examination (RCE), filing an appeal to the Patent Trial and Appeal Board (PTAB), or abandoning.

Milestone: Office action response filed within statutory deadline. Notice of allowance received.

Phase 9: Continuation and Divisional Filing Decisions

Before a parent application issues, evaluate whether to file continuation applications to pursue additional claim scope not covered by the parent. Common strategy: file a continuation claiming broader or different aspects of the invention to build a patent family.

A divisional application is filed when the USPTO issues a restriction requirement — the examiner determines that the application contains two or more independent inventions. The divisional allows you to pursue the restricted-out claims separately.

Deadline: continuations and divisionals must be filed before the parent application issues. Mark the anticipated issue date on your Gantt and set a decision review 60 days before that date.

Milestone: Continuation/divisional decision documented and filed (if pursued).

Phase 10: Grant and Maintenance Fee Schedule

Upon payment of the issue fee, the patent grants. The USPTO publishes the patent and it appears in search results. From the grant date, mark the following maintenance fee deadlines on your Gantt:

  • 3.5 years after grant: first maintenance fee due. 6-month grace period with surcharge.
  • 7.5 years after grant: second maintenance fee due. 6-month grace period with surcharge.
  • 11.5 years after grant: third maintenance fee due. 6-month grace period with surcharge.

Missing all maintenance fees causes the patent to lapse. After lapse, the patent cannot be revived for failure to pay maintenance fees (unlike some other abandonment situations).

Critical milestone: All three maintenance fee dates entered into IP docket and Gantt from day of grant.
