Federal: TTB Winery Basic Permit
The Alcohol and Tobacco Tax and Trade Bureau (TTB) Winery Basic Permit is required before any commercial wine production or sale. The application is submitted through TTB's Permits Online portal at no cost and typically takes 60-90 days for complete applications. The permit must be obtained before the first commercial batch.
Like the brewery context, the TTB permit requires a premises address, ownership information, and a basic facility description. It can be applied for while construction is underway.
State: ABC License
State alcohol beverage control (ABC) or liquor control board licensing for wineries varies by state. California's ABC issues winery licenses (Type 02) through an application process that typically takes 3-6 months. Other wine-producing states have their own timelines and requirements. If the winery plans to sell direct-to-consumer through a tasting room or wine club, additional retail licenses are typically required. If shipping wine directly to consumers in other states, direct-to-consumer (DTC) shipping licenses are required in each state where shipments will be sent -- 47 states now allow some form of DTC shipping, but licensing in each state takes 30-90 days.
County: Use Permit
This is often the most complex and time-consuming permit for a winery. Wineries are typically located in agricultural zones (Agricultural Preserve zoning in California, for example), and a commercial winery in an agricultural zone requires a conditional use permit. The use permit application involves a public hearing process: neighbors and county agencies review the application, environmental impacts are assessed, and conditions are imposed. Common conditions restrict the hours of operation, the number of visitors per day, event size limits, and parking requirements.
If the winery plans to host public events, weddings, or wine experiences beyond simple tasting room visits, the use permit requirements become more complex and the application process longer. In Napa County, use permit applications for new wineries have historically taken 12-24 months from application to approval. In other counties, the process may be faster or slower.
Plan for the county use permit to take 12-18 months and structure the project timeline accordingly.
The business plan defines the winery's production model: estate winery (processing only grapes grown on the property), custom crush (processing grapes for multiple clients), combination of both. Custom crush facilities typically have higher throughput requirements and more diverse equipment needs.
Appellation designation affects the label. If the winery intends to use an American Viticultural Area (AVA) name on the label, at least 85% of the wine must come from grapes grown in that AVA. The facility location relative to the vineyards affects logistics and label options.

Submit the county use permit application as early as possible. Winery facility design has specialized requirements driven by the nature of winemaking:
Crush pad: The area where incoming grapes arrive and are processed (crushed, destemmed, pressed) must be covered, with floor drains sloped to a collection sump. The crush pad is typically open-air or semi-enclosed with a concrete apron. It must accommodate the delivery truck footprint and the receiving equipment (sorting table, crusher-destemmer, press).
Tank room: Stainless steel fermentation and storage tanks require concrete floors with floor drains, adequate forklift access (tanks are moved during cleaning), and adequate ceiling height (tanks can be 20-30 feet tall for larger wineries). Electrical provisions for temperature control (glycol jacketing on tanks) must be coordinated with the equipment layout.
Barrel storage: Barrels must be stored at 55°F and 70-80% relative humidity for proper wine aging. This can be achieved through a purpose-built insulated barrel room with HVAC, through a cave (cut into a hillside), or through a combination. Barrel caves are carved using drilling and blasting or specialized tunnel-boring equipment in appropriate geology and provide passive temperature and humidity control with minimal ongoing energy cost.
Bottling room: Bottling operations require compliance with FDA food facility requirements: sealed floors, adequate drainage, pest exclusion. The bottling line requires space for the filler/corker, label applicator, case packer, and bottle staging areas.
Laboratory: Basic winery lab for pH, Titratable Acidity (TA), Brix (sugar), free and total SO2 monitoring throughout the winemaking process.

Winery construction is conventional commercial construction with the specialized requirements noted above. Cave construction, if included, is a specialty project requiring a cave drilling contractor and a separate permit. Cave timelines depend on geology: soft volcanic tufa cuts quickly; harder basalt takes longer. A 5,000-square-foot barrel cave takes 4-8 months to excavate and finish.

Tank installation requires a crane for large tanks. The installation sequence matters: tanks must be placed before walls or roof sections that would prevent access are completed, or wall panels must be designed to be removable for future tank changes.
Glycol refrigeration system commissioning: the glycol system that cools fermenting tanks must be operational before harvest.
Bottling line installation and testing: the bottling line requires calibration and test runs before it can be used for commercial bottling.

Each wine label must receive TTB Certificate of Label Approval (COLA) before the wine can be sold. COLA applications are submitted online and typically approved in 7-30 days for standard wine labels. Formula approval is required for wines with non-standard ingredients (flavored wines, wines with materials other than grapes).

The facility must be fully operational before the first grape delivery. Systems must be tested and ready: crush equipment calibrated, tank temperature control verified, lab equipment calibrated and supplies stocked, barrel storage at temperature, press tested and cleaned, staff trained.
